Kimber's been taken into custody!!

Again, I am so sorry this is happening. If you have a trainer or a behaviorist that you've worked with, see if they can be there for any behavioral assessments done with Kimber. Even if you don't have a behaviorist currently, you may want to get one and if there are "issues" that come up you already have someone who you've hired to work with. (I know the behaviorist I've worked with has done this for other families.)

Also, have you talked to shelter, will they let you see your puppy? Spend time with her? Again, it's very controlled, but our shelter will let families at least be on the other side of the kennel when a dog is being held.

As for the questions on can Animal Control just seize your dog, here in Rochester our AC officers are not peace officers. This means they don't carry guns and they cannot enter your home without permission. So I guess it depends on whether or not the AC officers are also peace officers.

No that's this guy that has a reverse brindle German Shepard mix. That dog is a lot smaller than my girl. He lives the next road over I believe. He always has his dog on a leash. This GSD lives about five houses down from us. We found out from our neighbors that the guy looking in on us and the guy right across the street "police" the neighborhood. I'm assuming that they're just the neighborhood nib shits. Old fellers with no life. We're in the middle of renovating a forclosure in an upscale neighborhood. The guy across the road said that people were suspicious of us because we're a young couple with a lot of nice things. I guess we looked like drug dealers, moving in from out of state with our dog posse. Who knows. Ever since I told one of the neighbors about calling the cops, he hasn't come our way but once.

They won't let us see her until she's been assessed and we just hired a trainer last week. Mainly to address some of her fears and help get our new pup on the right track. I called her and told her what happened though. She is supposed to be here next week.

Sorry to hear this happened, Kimber is a beautiful girl. We are pulling for you, I know I'd be thinking about busting down the walls of someone that was keeping my pups.

Food for thought if you have to take legal action or its taken against you limit what you post :)

Hope all goes well in her asessment. Not to make lite of the whole situation but as a last resort you may have to think about a jailbreaky

It's almost like I want to get a muzzle for Leo cuz he would do the same thing if a dog went after us...I am sorry this happen to you..so sad
 
Omg...so sorry to hear this:( This is heartbreaking! What the hell good is having a dog if it can't protect it's family!! Kimber was doing her job! I pray that she is assessed and found to have been acting in self defense. Keep us posted!

This is so upsetting. We get these dog for the love they give but also for how they show their love my being there for the family's . You had a baby there your dog did what it was suppose to do. We had a mastiff mix for ten years and when he started to show signs of old age behavior like this gsd we put him down and cried for days months even but the grand kids needed to be safe. This dog owner was wrong to not take care of this. And now this dogs last days are so very sad.

When they do the assessment, what do the do? Can you have anyone from "your side" present? Poor Kimber protected herself and her family, got hurt, now locked up in a strange place with strange people caring for her. She is probably very scared, I just wonder how she can get a fair assessment after all she is going through.
I would go nuts if that happen to me and my dog! I really hope she is back home soon!

True enough, though it seems like your family will be suing the other family for its negligence, still, let's all keep the comments here helpful and lose any rhetoric that a lawyer could spin doctor as liability on your behalf.
We're all concerned for you and your family, we all want the best for your pup, so let's help by keeping argumentative or libelous language out of the discussions.
How did the newspapers react to the story? We're you able to speak to any on air reporters? Try to get the story out there. I'm keeping an image of Kimber coming home to a celebration. Let's all imagine a good outcome for Kimbersmama.:pray:

"The owners told the police that the GSD was losing her mind in her old age. She's 8. Apparently her behavior has just taken a turn within the past few months, but they didn't realize that she'd go off the deep end."

It appears that the GSD's owners have given you all you need to make your case both with the AC and with the courts. There is an admission of negligence and foreknowledge. You wouldn't leave a loaded gun around, with the safety off, on a street where families live and play, why would you leave a dog unleashed when you know their deteriorating mental faculties make them as dangerous as that gun?

Take heart Kimbersmama, they have condemned themselves and their dog out of their own mouths. It is unfortunate that you have to wait for the wheels of justice to finish grinding. Kimber is a Hero. She should be treated as such. The GSD's owners should thank God that your child was unhurt. An increase in the price of their homeowner's policy is a small price to pay for their neglect.

You are in my prayers.

We were able to pick our baby up today. She's acting funny though. She was happy to see us, but has somehow squeezed her chunky butt under her futon and doesn't show any interest in coming out. The neighbors have willingly admitted fault and seem remorseful. The GSD was put down because of her age and injuries. As far as the legalities, nothing has really been determined. We're working on finding the next best course of action. I appreciate the support.
